Who will pay?

If we think that you have a good chance of making a claim for solicitors negligence or indeed any other professional negligence claim we will guarantee you a way of financing it.

On a successful case, (and we are confident that in most cases we will be successful); then the negligent party or their insurance will pay.

Different methods of funding the claim

  • No Win no Fee – The most utilised form of funding.
  • Legal Expenses Insurance
  • Private paying – For those without the benefit of insurance and those who do not which to enter into a no win no fee agreement.
  • Public funding – Exceptional circumstances only.

Our most popular way of funding

If, after discussion with yourself, we believe you have a valid claim we will ask you to pay £250 (plus VAT) which will be re-paid at the end of the case.

We will obtain your file from your Solicitors to confirm that you have a valid claim and will then contact you to let you know.

If you do have a claim we then instruct a specialist solicitor who obtains an advice from a specialist barrister. If both the solicitor and barrister are agreed then they deal with your case on a ‘no win, no fee’ agreement. Please note the fees as detailed below.

 

Time Limits

There is a time limit on making a claim which is 6 years from the negligent act, but there is a fall back position because if you were not aware of the negligence you can claim within 3 years of when you were aware or should have been aware of the negligence.

Charging Situations

Please note these charging situations:

If our solicitor tells you that you have a case and you decide not to proceed you will lose the £250 (plus VAT) you have paid us.

If, after an initial consultation, we both agree that there is a potential claim you will pay us £250 (plus VAT) to proceed. If however, after further investigation, our Solicitor decides that you do not have a valid claim, you will lose your £250 plus VAT).

If our solicitor tells you that you have a case and you do proceed, and your case is a success we will re-pay the £250 (plus VAT). If your case is unsuccessful, we will also re-pay the £250 (plus VAT).

If you don’t have a case

  • If, during the initial consultation, we say you have no case you owe us nothing.
  • If we say you have a case and in the unlikely event that you lose, you owe us nothing.
